MoP issues draft Electricity (Amendment) Rules, 2023

The MoP has issued the draft Electricity (Amendment) Rules, 2023. Accor­ding to the draft rules, a new rule is proposed to eliminate the requirement for a transmission licence to connect a large consumer and an energy storage system. To rationalise the open access charges, the draft rules prescribe a methodology for calculating various open access charges. Further, the draft rules aim to prevent the creation of revenue gap/regulatory ass­ets, except in extraordinary circumstances, and introduce a time-bound liquidation process for the same. Furthermore, it proposes to mandate upfront part payment of dues before filing an appeal before the Appellate Tribunal for Electricity or a higher court to discourage frivolous litigations.
